He was forfeited in the earldom but later restored, however the earldom did not pass to his eldest son from 1st marriage as the earldom was apparently created due to his 3rd marriage with Princess Margaret, sister of King Alexander II of Scotland and was to pass to his male heirs of that marriage, since he had no male issue from that marriage the earldom became extinct and reverted to the crown. His son from 1st marriage married the heiress of Lanvallei and Walker and continued the line there. His 2nd son from 1st marriage, also named Hubert, is said by Burke to be the ancestor of Thomas Burgh, 1st Baron Burgh of Gainsborough  -->
